the area of corporate, commercial and civil litigation, with particular
emphasis in shareholder litigation. He is a graduate of Osgoode Hall
Law School and was called to the Ontario Bar in 1991. He has advised
clients and acted as counsel in the resolution of disputes in all areas
of corporate and commercial activity including: shareholder and partnership
disputes director, officer and employee
litigation, with considerable expertise in their fiduciary obligations liability of professional advisors general commercial disputes Mr. Capern appears before all
levels of Ontario Courts and before a number of tribunals, and has
extensive experience in mediation and arbitration. He has been involved
in a number of significant briefs including: Acting for a number of corporate
stakeholders regarding Asset-Backed Commercial Paper (ABCP) Acting for minority shareholders
before the Ontario Securities Commission in Hollinger. Acting for the City of Toronto at
the Toronto Computer Leasing Inquiry. Advising boards and special
committees in various matters involving director and officer liability. Acting for the successful
respondent at the Ontario Court of Appeal in a decision which
established the proper procedures in pursuing shareholder derivative
actions. He is active in The Advocates'
Society, where he participates regularly as a panelist and instructor,
and has acted as a professional mentor to law students. He is the
partner in charge of information technology and litigation support for
Paliare Roland. Mr. Capern is on the board of the Canadian Foundation
for AIDS Research (www.canfar.com), where he also co-chairs AIDSbeat
(www.aidsbeat.com), the legal community's annual rock 'n' roll bash. Mr.
Capern acts as Vice-Chair of the Canadian board of the African Medical
and Research Foundation (AMREF Canada - www.amrefcanada.org) which funds
and builds medical and health infrastructure projects in the neediest
parts of Africa. AMREF was a recipient of the 2005 Bill and Melinda
Gates Foundation Award. |
