About the Program

The use of expert witnesses can be critical to the outcome of a case - their testimony offers you unique opportunities, but also specific challenges. This program will provide a general framework to prepare for and conduct examination-in-chief and cross-examination of expert witnesses at trial and in hearings. In the morning, presenter Richard Shekter uses anecdotal stories and real transcripts to teach you fundamental strategies to successfully examine and cross-examine any expert witness. Drawing on some of his most interesting cases, Richard shares specific ideas for implementing your litigation goals when offering or challenging expert testimony. Topics include the general law governing admissibility of expert opinions, using an expert to strengthen your case, philosophy of cross-examination, examination and cross-examination techniques, and ethical and professional responsibility issues when dealing with experts.

Participants who select full day registration will also participate in an afternoon skills building workshop with a blue ribbon faculty made up of experienced local practitioners. Every participant will conduct a mock chief examination and cross examination and receive feedback. Advance preparation is required. Afternoon enrolment is limited.

This course is designed for all lawyers – including experienced practitioners – who want to build or enhance their preparation and presentation skills of expert witnesses.

 

 

Lead Instructor

Richard ShekterRichard Shekter is recognized as one of Canada’s leading litigators. As the founding senior partner of the firm Shekter, Dychtenberg LLP in Toronto, he practises in the field of criminal, civil, health, personal injury, corporate, medical malpractice, employment law and administrative litigation. He is general counsel to the College of Massage Therapists of Ontario and the College of Dental Technologists of Ontario and also appears regularly before other health colleges representing a variety of health care and other professionals including physicians, dentists, and nurses. In May of 1998 Mr. Shekter became the second recipient of the Ontario Trial Lawyers Association - H. Bruce T. Hillyer Award for Outstanding Advocacy. Mr. Shekter appears regularly on television and radio as a legal commentator. He writes and lectures widely on legal matters, in particular expert evidence, and was the legal affairs columnist for Family Practice, a McLean-Hunter Publication. Mr. Shekter is a former Director of the Ontario Trial Lawyers Association and The Advocates’ Society, is a former vice-chairman of the Civil Liberties Section of the Ontario Bar Association, past Chairman of the Health Law Section of the Ontario Bar Association, a Canadian delegate to the Council of the Association of Trial Lawyers of America, a member of the Criminal Lawyers Association, the Association of Trial Lawyers of America, the Ontario Trial Lawyers' Association, the Metropolitan Toronto Lawyer's Association, the Medico-Legal Society and The Advocates’ Society.
