The first session of a two part program brings together experienced counsel and the bench to teach you planning, preparation, and effective execution of examinations for discovery.  How do you plan to use your discovery transcript? How should you prepare your witness? What’s the best approach to handle difficult witnesses and difficult opposing counsel? And how can you effectively protect your client at discovery with civility? Examinations for discovery are one the most important puzzle pieces in the litigation process. Planning your discovery requires you to look at the big picture, but you also need to know the details of your documents and your witness’s evidence. And if you think you’re nervous… just think how your client feels. Your client needs preparation, advice on how to conduct themselves in an examination, and your protection through the process. Finally, examinations for discovery can be full of surprises. Difficult witnesses, and difficult counsel can throw you off your game.  

The Advocates' Society will bring together experienced counsel and the bench to help you understand how to use your discovery transcript, to prepare for your discovery, and to control your discovery.  Through commentary and demonstrations we will show you tips and tricks for dealing with difficult witnesses, and how to handle bullying counsel.
