Interactive Plenary Session: Brainstorming the Facts
All participants (A’s for the plaintiff Sandy Patterson and B’s for the defendant B. Ware Riding Academy) should be prepared to discuss key issues in the case, good facts/bad facts for their side, and what witnesses and available documents will help them prove or disprove elements of the cause of action.

Interactive Plenary Session: Developing a Theory and Supporting Themes
All participants should be prepared to discuss their theory/theories of the case from their side and possible themes. What is your client’s story, why should they win, and how can you portray them in a way that makes the judge want to help them?

Interactive Plenary Session: Orientation to Examination-in-Chief: Who to Call, What You Need from Them, and How to Help Them Tell Their Story
All participants should be prepared to discuss key goals of an effective examination-in-chief, what information they need from their witness, and how to organize and frame questions in a way that lets the witness tell the story.
Faculty Presentation: Quick Refresher on Examination-in-Chief and Exhibits
All participants should be able to describe the steps required for introduction of documents into evidence.

Small Groups: Examination-in-Chief
A’s will take turns one after another conducting a 5- 7 minute examination-in-chief of the plaintiff, Sandy Patterson.
B’s will take turns one after another conducting a 5- 7 minute examination-in-chief of Sam Bradley on behalf of the defendant, B. Ware Riding Academy. Where possible, all participants should attempt to introduce into evidence and use at least one exhibit.
When not conducting an examination, A’s will play the role of Sandy Patterson and B’s will play the role of Sam Bradley. Please prepare a complete examination, as you may be asked to pick up or circle back to where another participant left off. After each presentation, faculty members will provide individual feedback.

All participants should be prepared to discuss key goals of an effective cross-examination, what information they need from the opposing witness, and how to organize and frame questions in a way that counsel controls the testimony.
Faculty Demonstration: Cross-Examination
Faculty Demonstration: Impeachment with a Prior Inconsistent Statement
All participants should be able to describe how impeachment is a component of cross-examination, and the steps required to impeach a witness with a prior inconsistent statement.

Distribution of Examination-in-Chief Transcripts and Discussion
Participants will receive and review examination-in-chief transcripts of Sandy Patterson and Sam Bradley in preparation for the cross-examination and impeachment exercises on Day 2.

Small Groups: Cross-Examination
B’s will take turns one after another conducting a 5 - 7 minute cross-examination of the plaintiff, Sandy Patterson.
A’s will take turns one after another conducting a 5 - 7 minute cross-examination of Sam Bradley.
Where possible, participants should attempt to impeach the witness with a prior inconsistent statement.
When not conducting an examination, A’s will play the role of Sandy Patterson and B’s will play the role of Sam Bradley. Interactive Plenary Session: Orientation to Closing Argument
All participants should be prepared to discuss key elements and objectives of an effective closing argument, and strategies and techniques to summarize the evidence in a way that shows they have met their burden of proof or their opponent has failed in this task.

Small Groups: Closing Argument
A’s and B’s will alternate delivering a closing argument for their side. A’s will deliver a 10-minute closing on behalf of the plaintiff, Sandy Patterson. B’s will deliver a 10-minute closing on behalf of the defendant, Sam Bradley.
Participants will be expected to integrate the evidence given by Sandy Patterson and Sam Bradley during the examination-in-chief and cross-examination role play exercises on Day 2 of the workshop and the written statements of Drew Stevens and Alex Johnson. After each presentation, faculty members will provide individual feedback.
