As an estates practitioner, it's not often you have the opportunity to learn how to prepare and argue a motion in a practical, concrete way. The plenary program will be held on January 20 and the learn-by-doing skills workshop will be held January 21. There are two registration options: (1) plenary + workshop or (2) plenary only (see below for more information).
Plenary Details | January 20, 2021, 9:00 a.m. to 12:00 p.m. ET
In the January 20 portion of our program, leading practitioners and judges of the estates bar and bench will discuss and demonstrate the tips, tricks and strategies you need to succeed at your next estates motion.
Topics Include:
- Mastering notices of motions and affidavits
- Drafting compelling factums
- Effective estates motion oral advocacy
- Managing your clients’ expectations
- What judges want from estates litigators
Workshop Details | January 21, 2021, 1:00 p.m. to 4:00 p.m. ET
Participants in the plenary session are also eligible to join us for our hands-on skills workshop, which will be held fully remotely. The workshop is your chance to practice and refine your estates motion advocacy skills in a supportive environment. You will get practical, individualized feedback from our trained faculty, and you will also learn from your peers as you work through the interactive exercises in small groups. Please also note that this program requires preparation based on a mock case file, which will be provided to you in advance of the program.
Here's a sneak peek of our fact scenario:
Reclusive best-selling mystery writer Norval Thrombey was found murdered at his Port Ticonderoga mansion on the eve of his 85th birthday party. The weapon was a fork from his extensive antique fork collection. Norval was widowed and was survived by his two children: Laura and Wayland, both of whom attended his birthday party. His body was discovered by his live-in nurse, Marta Cuchara. Despite Laura and Wayland having a clear motive to murder Norval, suspicion quickly turned to Marta after Norval's will was discovered. Made one week before the murder, Norval's signed will left everything to Marta and named her trustee and executor. Laura and Wayland immediately commence a court application to set aside the will on the grounds of lack of testamentary capacity and undue influence. They also bring a motion for directions, seeking that an estate trustee during litigation (ETDL) be appointed and that Wayland be put in charge of managing the family publishing business. Marta intends to oppose Laura and Wayland's requests.
Join us for this program to delve deeper into this mystery and hone your advocacy skills while you’re at it!
